Terms of Service — ZigaStore

These Terms of Service ("Terms") govern your access to and use of zigastore.com and any related content, features, products and services (the "Services"), operated by ZigaBit Store ("ZigaStore", "we", "us", or "our"). By accessing or using the Services, or by purchasing from us, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Who we are and how to contact us

ZigaStore is an online store selling digital, downloadable products. You can reach us at info@zigastore.com.

2. Eligibility

You must be at least 18 years old, or use the Services under the supervision of a parent or guardian, and be able to form a legally binding contract, to purchase from us.

3. Our products are digital downloads

All products sold through the Services are digital files (for example, printable wall art and other downloadable digital goods). No physical item is shipped. After purchase, you receive access to download the files. You are responsible for downloading and saving your files and for having the software and devices needed to open and print them. Colours may vary depending on your screen, printer, paper and settings.

4. Orders, pricing and payment

Prices are listed in GBP and may change at any time before you purchase. We may correct pricing errors and cancel affected orders. Payment is processed by our payment providers (including Shopify and its payment partners); by purchasing, you authorise us and our providers to charge your chosen payment method. We may refuse or cancel any order, including where we suspect fraud or a breach of these Terms.

5. Licence to use the products

Unless a listing clearly states otherwise, each product is provided to you under a personal-use licence: you may download, print and display the files for your own personal, non-commercial use. Where a listing expressly grants a commercial (small-business) licence, you may also use the files in your own small-business marketing and products up to a reasonable small-business scale, as described on that listing.

In all cases you may not:

• resell, redistribute, share, sub-license, or give away the digital files themselves, whether as-is or modified;
• claim authorship of the artwork or register it as your own;
• use the files in a way that is unlawful, infringing, or harmful.

We (and our contributing studios) retain all ownership of the artwork; you receive a licence to use it, not ownership of it.

6. Intellectual property

All content on the Services — including artwork, designs, text, graphics, logos, and the ZigaStore and studio brand names — is owned by us or our licensors and is protected by intellectual-property laws. Except for the licence granted in Section 5, nothing in these Terms transfers any intellectual-property rights to you.

7. Refunds and returns

Because our products are instant digital downloads, all sales are final and we do not offer refunds or exchanges once files have been delivered, except as set out in our Refund Policy (for example, faulty, undelivered, or materially not-as-described files). Please see our Refund Policy for full details. This does not affect your statutory rights.

8. Acceptable use

You agree not to misuse the Services, including by: attempting to gain unauthorised access; interfering with or disrupting the Services; using automated means to scrape, copy or harvest content; uploading malicious code; or using the Services in violation of any applicable law. We may suspend or terminate access for any breach of these Terms.

9. Third-party services and links

The Services rely on and may link to third-party services (such as Shopify for hosting and payments). We are not responsible for the content, policies, or practices of third parties. Your use of those services is governed by their own terms and privacy policies.

10. Disclaimers

The Services and products are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that files will meet your specific requirements or be compatible with your devices or software.

11. Limitation of liability

To the fullest extent permitted by law, ZigaStore and its studios will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or relating to your use of the Services or products. To the extent we are found liable, our total liability to you for any claim will not exceed the amount you paid for the product giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law (such as for death or personal injury caused by negligence, or for fraud).

12. Indemnification

You agree to indemnify and hold harmless ZigaStore and its studios from any claims, losses, or expenses (including reasonable legal fees) arising from your misuse of the Services or products or your breach of these Terms.

13. Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted on this page, and the "Last updated" date will reflect the most recent version. Your continued use of the Services after changes are posted means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of Scotland, and the courts of Scotland will have exclusive jurisdiction, except where applicable consumer-protection law gives you the right to bring proceedings in your own place of residence. 

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
